TERMS AND CONDITIONS OF THE ACCOMMODATION AND EVENTUAL TOURIST STAY SERVICES CONTRACT, HEREIN “THE CONTRACT”, ENTERED INTO BY ONE PARTY NEO OFFICES SA DE CV, WHO HEREIN WILL BE CALLED “THE HOST”, AND BY THE OTHER PARTY “THE GUEST” INDICATED IN THE “RESERVATION”, AS DEFINED BELOW AND WHICH FORMS AN INTEGRAL PART OF THE CONTRACT, WHO JOINTLY WILL BE REFERRED TO AS “THE PARTIES”, IN ACCORDANCE WITH THE FOLLOWING STATEMENTS AND CLAUSES:
D E C L A R A C I O N E S
I. “The Host” declares that:
It is a legal entity legally constituted in accordance with Mexican laws, which is accredited by the testimony of public deed number 7450, dated December 2, 2014, granted before the faith of Carlos Cataño Muro Sandoval, Notary Public number 51, in Mexico City, and registered in the Public Registry of Commerce of Mexico City under number 532731-1, dated March 27, 2014, and that Yosef Zonana Guiznberg, in his/her capacity as legal representative, in this act intervenes with the powers conferred upon him/her in the testimony of public deed number 7450, dated December 2, 2014, granted before the faith of Carlos Cataño Muro Sandoval, Notary Public number 51 of Mexico City, and that said powers have not been revoked, modified or limited as of the date of signing of this Contract.
Its business includes the provision, on its own behalf or through third parties, of Lodging and Occasional Tourist Stay services in properties for residential use, whether houses or entire buildings, or in their rooms or apartments separately (hereinafter, individually referred to as the "Property"). Its registered office is located at C. Atlixco 76, Colonia Condesa, Cuauhtémoc, 06140 Mexico City, CDMX, Mexico, where it provides the Lodging and Occasional Tourist Stay Services subject to this Agreement (hereinafter, jointly, the "Lodging Services"), which it designates as its conventional address for all purposes of this instrument.
It is registered in the Federal Taxpayers Registry with the code NOF141202L15;
The property has safe and hygienic facilities and the necessary conditions and supplies to provide lodging services, as well as staff trained to handle incidents related to acts of discrimination.
It is prohibited to deny, exclude, or distinguish access to or provision of services to any person or social group based on their skin tone, ethnic origin, national origin, race, language, sex, gender, age, disability, legal, social, or economic status, indigenous identity, gender identity, physical appearance, health conditions, religion, ways of thinking, sexual orientation or preference, having tattoos, piercings, or any other reason that aims to impede the enjoyment and exercise of human rights.

The Guest has been informed of the features and rates of the Lodging Services, including any additional services, as well as the applicable Lodging Tax rate in Mexico City.
The Guest has been informed of the terms and conditions set forth in this Agreement, as well as the Rules or Regulations for use of the Property, hereinafter simply the "Property Regulations," which are available for viewing and download at the Property and on the website: https://be.nomadierliving.com/terms-and-conditions.
The Guest's personal data will be protected and processed solely for the purpose of providing the Accommodation Services and in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties. For more information about the processing and protection of your personal data, please consult the privacy notice at the Property and on the website: https://be.nomadierliving.com/es/terms-and-conditions.
II. “The Guest” declares that:
You are a natural person with the legal and financial capacity to be bound by the terms of this Agreement, and you are identified by an official document proving your age of majority.
Has the occupation, origin, provenance and place of residence indicated in the “Reservation”, as defined below.
He declares under formal oath that he has a family relationship, legal guardianship or custody of the minors accompanying him (if applicable), as certified by a suitable document.
The property has safe and hygienic facilities and the necessary conditions and supplies for lodging.
Be fully familiar with the property's features, facilities, location, surface area, capacity, condition, accessories, services, and corresponding common areas.
Learn about the rates for the Hosting Services provided by the Property, including any additional services.
Learn about the applicable tax rates, including the Lodging Tax applicable in Mexico City, and comply with them.
You are familiar with the terms and conditions set forth in this Agreement, as well as the Property Regulations; documents you acknowledge having read and having at your disposal.
Learn about the treatment and protection provided by the Host to your personal data.
By virtue of the foregoing Declarations, “The Parties” agree to be bound by the following:

FIRST.- CONSENT.-By confirming the reservation of the Property, made by the Guest either directly or through third parties, whether through Technological Platforms or through duly authorized Online Travel Agencies (OTAs), or by reserving directly with the Host, or simply by signing the Property Registration Sheet (Annex A), hereinafter referred to interchangeably as the "Reservation", the parties express their willingness to be bound by this Agreement, with the Host obligated to make the Property available to the Guest in accordance with the provisions of the Reservation, and the Guest, in turn, agrees to pay the true and determined price in effect at the time of making the Reservation, agreeing to comply with all the terms and conditions of this Agreement.
All persons staying at the Property, regardless of whether the Reservation was made by a Third Party, are subject to all the Terms and Conditions of this Contract for that sole fact, and therefore will also be considered individually as Guests, being jointly responsible with the person who made the Reservation, for compliance with all obligations established by them in this Contract.
SECOND.- OBJECT.-The purpose of this Agreement is the provision of Accommodation Services and Occasional Tourist Stay in the Property ("the Accommodation Services"), by the Host and in favor of the Guest, whose characteristics and variable rates, according to market prices, are indicated both in the lists made available to the general public through the websites and applications of the Technological Platforms and OTAs, as well as in the Fee List (Annex C) which forms an integral part of this Contract, which is available to the general public and the guest both in the Property andon the website: https://be.nomadierliving.com/es/terms-and-conditions.
The parties agree that the Hosting Services do not include complementary services, such as food and beverage sales services; cleaning, laundry or ironing services; hairdressing or spa services; office or coworking services, events or entertainment services; among other similar services that are subject to availability in each case and are indicated in the Complementary Services Price List (Annex D) is for informational purposes only; nor are external services provided by third parties included.
THIRD.- ACCOMMODATION RATE.-The parties agree that the price to be paid by the Guest, as consideration for the Accommodation Services, is the price informed to the Guest at the time of confirming their Reservation or, where applicable, any modification authorized by the Host; and, failing that, it is the price resulting from applying the current prices published in the Rate List (Annex C) made available to the Guest (the "Accommodation Rate") to the number of nights of stay.
To the Accommodation Rate, the price of the additional Accommodation services, indicated in the Rate List (Annex C), which are accrued by the Guest during his/her stay must be added, Hereinafter referred to as the “Total Accommodation Rate”; the Host is obligated to respect all prices and may not charge the Guest for other services without their consent.
The Guest is responsible for any Modification made to the Reservation, agreeing to pay any additional amount, commission or tax associated with it.
FOURTH.- FORM AND PLACE OF PAYMENT.-The Guest will make payment of the Accommodation Fee,in national currency, at the time and in the manner stipulated in the Reservation, through the payment systems of the Technological Platforms or the OTAs, as the case may be, or, failing that, directly to the Host at the Property, no later than the day of your departure ("Check-out").
Guests may make all applicable payments in cash, by debit card, credit card, electronic funds transfer, or bank deposit, providing proof of payment. Guests may also make payments in foreign currency at the exchange rate published in the Official Gazette of the Federation on the day of payment. All payments will be deemed received unless they are properly collected.
The Guest authorizes the Host to hold funds or pre-authorize his/her debit or credit card on the day of arrival ("Check-in") or prior to this date, to guarantee payment of the Accommodation Fee, in case he/she does not prove to have already covered it, as well as as a deposit that guarantees payment of additional services.Accommodation and any additional services you may require during your stay, as well as any damage you may cause to the Property.
If the Guest does not prove payment of the Accommodation Fee on the day of Check-in or does not guarantee it in any way during their stay, the Host will be authorized to cancel the Reservation and deny access to the Property, or evict them.
The Guest may make the required deposit, in accordance with the previous paragraph, in cash on the day of Check-in, if they do not have another means of payment or the one used is not sufficient, and must wait for its return or release until the Host reviews that there are no outstanding debts or damages to be covered.
By the day of check-out, the Guest must have paid the total rate for the accommodation and the total price of the additional services.
Under no circumstances may the Guest withhold or condition payment of the Accommodation Fee, any additional services, or any accrued service, for any reason or under any circumstances. Upon the payment due date, the Host will be deemed to have made the corresponding payment request to the Guest in a timely manner for all legal purposes.
Late payment of any service payable by the Guest will incur late payment interest at a rate of 0.5% per day on outstanding balances, until fully settled (the “Surcharges”).
If the Provider incurs any bank fees arising from the payment method chosen by the Guest, they must be fully covered by the Guest.
In the event of any outstanding debt owed by the Guest, the Host may apply the Deposit to the payment thereof up to the limit, without prejudice to the continued obligation to pay the remainder.
In the event of a refusal to pay by the Guest, the Host shall be prohibited from retaining the Guest's luggage. The Host shall request immediate intervention from the competent authorities. Pursuant to Article 2669 of the Civil Code for Mexico City, the Host may retain the Guest's luggage as collateral until payment of the outstanding amount is obtained.
FIFTH.- RECEPTION AND DEPARTURE OF THE GUEST.-The Host will deliver the Property to the Guest no later than 15:00 (fifteen) hours on the day of arrival ("Check-in"), and the Guest must vacate the room no later than 10:00 (ten) hours on the day of departure ("Check-out"). The Guest will have the right to a grace period of 60 (sixty) minutes from the time of departure to vacate the Property without charge, otherwise he/she will have to pay the current rate for that night or the additional nights that he/she occupies the Property, in accordance with the Rate Schedule (Annex C). In any case, the Guest accepts that the Host will carry out the automatic charge of the additional night(s) to the registered Payment Method, once the tolerance period has elapsed, without prejudice to the deposit made.
SIXTH.- COMPLEMENTARY AND EXTERNAL SERVICES.-As a complement to the Hosting Services, the Host may provide the Guest, at the Property, the complementary services indicated in the Complementary Services Price List (Appendix D), which is available to the Guest for consultation both at the Property and on the website: https://be.nomadierliving.com/es/terms-and-conditions.
These services, subject to availability in each case, may consist of food and beverage sales services; cleaning, laundry or ironing; hairdressing or spa services; office or coworking services, events or entertainment services; among other similar services; and must be authorized by the Guest.express form in it Annex A.
External services provided by third parties, such as travel agency services, tours or tourist guides; courier or delivery services; car rentals, taxis or shuttles; among other similar services; that have been disseminated by the Host in accordance with commercial collaborations, are the exclusive responsibility of those who provide them, and must therefore be expressly authorized by the Guest and covered by the contract.directly to external providers,in accordance with its own terms and conditions, the Host disclaiming any liability related to these.
SEVENTH. RESTRICTIONS.-The Host shall ensure that the safety of the guests is maintained and that the Property is not used for activities that disrupt public order or affect the social interest, or for the possible commission of a crime, in which case the Host shall notify the competent authorities.
As a result of the above, it is strictly prohibited:
Entry into the premises of minors who are not accompanied by someone who can prove they are related to them, their guardian, or their custodian; and of those who do not register.
Access to the property with pets is subject to availability, except for assistance or companion dogs.
Access to the Property with any type of weapon without the corresponding valid license or authorization, in accordance with Articles 24 and 35 of the Federal Law on Firearms and Explosives. In these cases, the possession of weapons must not disturb the peace and order of the Property and must be displayed publicly. The Host must also be notified.
Generate noise that affects third parties.
Exceeding the capacity of the property.
Smoking is prohibited inside the building and in all enclosed spaces open to the public.
The betting exchange inside the property.
Panhandling, pornography, prostitution, drug use and trafficking, health crimes, corruption of minors, sex tourism, and human trafficking for sexual exploitation.
The recording or video recording of commercial content, video or photographs within the Property.
Damage, modify, alter or intervene in any way in the Property, its facilities, finishes or furnishings.
EIGHTH. OBLIGATIONS OF THE PARTIES.
THE HOST IS OBLIGED TO:
Confirm the Reservation to the Guest, after informing them of the characteristics and rates of the Accommodation Services, as well as any additional services.
Inform the Guest about the terms and conditions set forth in this Agreement, and comply with them.
Inform the Guest about the Lodging Tax applicable in Mexico City.
Inform the Guest about the Property Regulations.
Inform the Guest of any restrictions or prohibitions that apply within the Property.
Do not discriminate against the Guest in any way.
Handle complaints, claims and grievances from the Guest.
Allow access to the property to authorized personnelby the Institute of Administrative Verification, as well as to police personnel in compliance with a commission.
Allow access to the Property to assistance dogs.
Issue and deliver to the Guest the tax receipt that covers the charges made for the Total Rate of the Accommodation and complementary services.
Protect the Guest's personal data.
Take advantage of the property's civil liability insurance.
THE GUEST IS OBLIGED TO:
Show an official document that proves your age of majority, as well as register and register your companions and visitors in theAnnex A.
Prove with an official document that you have kinship, guardianship or custody of minors who accompany you and register them in theAnnex A.
Inform the Host, before making the Reservation, if you intend to enter theProperty with pets, which in all cases are subject to the Terms and Conditions established in this Contract.
Control the arrivals and departures of the property, including the name, occupation, origin, provenance, place of residence, and emergency contact information for all property occupants.
Observe and have your companions and visitors observe the rules of hygiene and social coexistence.
Do not perform acts contrary to the rules, and do not engage in offensive or discriminatory conduct.
Respect and ensure that your companions and visitors respect the Building Regulations.
Pay the total rate for the accommodation in the manner established in the reservation and no later than the day of check-out, without having filed a claim that exempts you from payment.
Do not subsequently request cancellation or chargeback of legitimate charges made by the Host from your banking institution.
Respect and ensure that your companions and visitors respect the natural, cultural, and historical environment, as well as the customs, behaviors, and beliefs of the place.
Comply with and enforce the terms and conditions of this Agreement by their companions and visitors.
Cover the payment of the Lodging Tax applicable in Mexico City, as well as the Value Added Tax.
Comply with any restrictions or prohibitions that apply to the Property.
To use the property exclusively for residential use, and to take care of it as if it were your own.
Do not disturb public order or affect social interests.
Allow access to the Property to the Host or their staff for maintenance or cleaning of the property, or in cases of emergency.
Allow access to the property to personnel authorized by the Administrative Verification Institute, as well as to police personnel on assignment.
Authorize automatic charges, through the pre-authorized payment method or any other payment method, for all damages or losses caused to the Property, its furnishings, installations, or finishes, which are duly verified according to the depreciation of the property. Otherwise, the property shall be brought before the authorities for the corresponding crime.
Cover the corresponding amounts for fines to which you may be subject for breaching the Terms and Conditions of the Contract, or the Property Regulations, in accordance with the amounts established in the Fee Schedule (Annex C).
NINTH.- PROPERTY REGULATIONS.-The parties agree that the use of the Property facilities (in addition to what is stipulated in this Agreement) is subject to the provisions of the Property Regulations, a document that is added to this Agreement as Annex B, and which is available to the Guest for consultation and download, both at the Property and on the website: https://be.nomadierliving.com/es/pages/reglamento-del-inmueble.
The Guest acknowledges that by simply staying at the Property, he or she accepts the rules contained in the Regulations, which govern the proper use of the Property's facilities, without prejudice to the provisions of this Agreement.
TENTH. CANCELLATION POLICIES.-Reservation cancellation is applicable in each specific case, subject to the corresponding cancellation policy, as follows.
In cases where the Reservation has been confirmed through Technology Platforms or through duly authorized Online Travel Agencies (OTAs), the cancellation policy in effect for the corresponding medium at the time the Reservation was confirmed will apply, and the cancellation must be made according to the procedure indicated therein.
The same will apply if the Host is forced to cancel a Reservation confirmed through any of these means, through no fault of the Guest.
In cases where the Reservation has been confirmed directly with the Host, or in the absence of any other applicable cancellation policy, provided it is done in writing and the Hosting Services have not been provided to the Guest, the following cancellation policy will apply:
To receive a full refund, Guest must cancel at least 30 days prior to check-in.
If cancelled between 15 and 30 days prior to arrival, Guest will receive a refund of 50% of the reserved nights.
If cancelled less than 7 days prior to arrival, Guest will not receive any refund.
The Host will have the option to offer a different date to the Guest, subject to availability.
In the event that the reservation is subject to a direct promotion by the Host, the Guest agrees that the rate will not be refundable.
In these cases, the Host must respond to the Guest's cancellation request within 120 (One Hundred and Twenty) hours and in the absence of a response, it will be understood that the cancellation was accepted, without prejudice to the penalties indicated above.
In the cases of the previous section, when the Host is forced to cancel the Reservation, without fault of the Guest, and the total Rate of the Accommodation is covered, the following cancellation policy will apply:
The Host must issue a full refund if you cancel at least 24 (Twenty-Four) hours before Check-in.
If you cancel between 24 (Twenty-Four) hours before Check-in and Check-in, the Host must issue a full refund or, if applicable, may provide you with a similar Hosting service to the one agreed upon, with the same conditions and characteristics.
If you cancel after check-in, the Host must issue a 100% refund for the unused nights or, if applicable, may provide you with a similar accommodation service to the one agreed upon, with the same conditions and features.
In cases where the Guest does not show up at the Property on the day of Check-in ("No show"), the Host will be authorized to charge 100% of the the total rate of the accommodation, regardless of whether the guest shows up later and only uses part of the reserved nights.
ELEVENTH. CAUSES FOR TERMINATION.-The failure of either party to comply with any of the restrictions or obligations established for them herein shall be grounds for termination of this Agreement.
In the event of termination of this Agreement due to the fault of the Guest, the Guest shall not be entitled to any refund or compensation. The Guest shall also be responsible for any damages incurred by the Host, using the payment method used to cover or guarantee the Accommodation Fee and/or any other service due, or, if this is insufficient, using any other payment method. In these cases, the Host shall be authorized to deny access to the Property or evict the Guest.
In the event of termination of this Agreement due to the Host's fault, the Host shall have the right to correct the reason for non-compliance within a period of 72 (seventy-two) hours, otherwise the Host shall issue a refund corresponding to 100% of the price of the nights actually paid, which have not been enjoyed by the Guest, or may offer the Guest the option of an additional service or Substitute Accommodation, in accordance with the following Clause.
TWELFTH.- TWELFTH.- SUBSTITUTE ACCOMMODATION.-In the event that the Host does not provide the Guest with the Hosting Services under the conditions and specifications agreed upon in this Agreement, the Guest may choose between receiving a Hosting service similar to that agreed upon, offered by the Host, with the same conditions, features and price, or terminate the agreement in accordance with the terms of the previous Clause.
Property availability may vary due to operational or maintenance needs. The Host reserves the right to assign the Guest a similar accommodation without prior notice if necessary to optimize their experience or for operational reasons.
Accommodation changes at the Guest's request or due to error are subject to availability and prior payment of the applicable rate difference. The Host will inform the Guest as soon as possible of the availability and rate of the new accommodation, upon request, as well as the applicable rate difference to cover the blocked Reservation, if applicable.
THIRTEENTH. FORTUOUS EVENT AND FORCE MAJEURE.-A fortuitous event or force majeure is understood to be those facts or events beyond the control of the parties, provided that said facts or events are disruptive, unforeseeable, irresistible, insurmountable, current and do not arise from any negligence or fault of any of the parties.
When the Hosting Services are not provided due to an unforeseen event or force majeure, the Guest will be entitled to a 50% refund of the payments actually made directly to the Host. If the Hosting Services were partially provided, the Guest will only be entitled to a 50% refund of the proportional portion of the Hosting Services not provided.
When the Guest has contributed in any way to the fortuitous event or cause of force majeure, which totally or partially prevented him from using or enjoying the Property, he will be obligated to pay 100% of the total Rate of the Accommodation.
FOURTEENTH.- ASSISTANCE AND COMPANION DOGS.-The Guest may enter the Property accompanied by an assistance dog, without condition or additional cost, provided that the need for assistance is evident to any person or, failing that, only if they present a recent document issued by a specialized medical professional, which includes their professional license number and the indication that the person is under professional care for their condition and that the dog is required for assistance.
If the Guest cannot verify that the animal is an assistance dog, it may be brought into the Property as a companion dog, subject to space availability and the additional fee, which can be found in the Fee Schedule (Annex C). In all cases, the dog must have a current vaccination record to be allowed into the Property.
The dog must be kept on a leash or harness with an identification tag at all times in all public areas; it may not be left unattended at any time, even inside the property. Pets are not permitted on beds or furniture. Bathing or grooming pets on the premises is prohibited. Pets' needs must be attended to off-site. Failure to comply with this requirement will be grounds for termination of the lease.
In the event that the dog damages the Property, its furnishings, facilities, or finishes, the Guest must cover the Host's cost of cleaning, repair, or replacement.
FIFTEENTH.- CIVIL LIABILITY.-The Host shall not be liable in any way for incidents occurring at the Property, whether due to the fault or negligence of the Guest, their companions and/or visitors, or due to an act of God or force majeure; including, but not limited to, personal injury or property damage, or accidental death; as well as damage to the Property and to third parties, their personal injury or property.
The Guest agrees that the Property has the civil liability insurance provided for in the applicable regulations in Mexico City, so if the Reservation was made through technological platforms, if they provide it, the Guest agrees that it will be sufficient.
SIXTEENTH.- PRIVACY NOTICE.-Both parties acknowledge that prior to signing this Contract and in compliance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties, the Host made the Guest aware of the procedure to exercise the rights of access, rectification, cancellation and opposition to the processing of their personal data, through theirprivacy noticeavailable at the Property and on the website: ____________________________.
Without prejudice to the foregoing, the Guest agrees and authorizes the Host to transfer his or her personal data to the Mexico City Tourism Secretariat and other competent authorities that so require, in accordance with the Mexico City Tourism Law and other applicable legal provisions.
SEVENTEENTH.- CONTRACTING BY ELECTRONIC MEANS.-The parties agree that this Agreement and its Annexes, the Reservations made through Technological Platforms or through OTAs, as well as any form of manifestation of consent, approval or other documents related thereto, do not require original autograph signatures for their validity, and therefore may be signed through the use of electronic or digital signatures, or through the use of numeric, alphanumeric characters, voice prints, biometric data or any other form required for access to the Technological Platforms or data transmission systems, and that said alternative means of signature and the records in which they are applied, will be considered valid for all purposes, including but not limited to civil, commercial, administrative and consumer protection legislation, as well as NOM-151-SCFI-2016, with the same force and consequences as the original autograph signature of the signing party.
If the Contract or any other document related thereto is signed by electronic or digital means, the Parties agree that the Contract forms and other documents signed in this manner will be kept and made available to the Parties, and therefore agree that all information exchanged between them for the execution of this Contract will be considered delivered at the time it is sent, in accordance with the data transmission system used, provided that there is confirmation of receipt.
EIGHTEENTH.- PRE-AUTHORIZATION AND FUNDS RELEASE POLICY.-The Guest agrees that upon making their Reservation or during Check-in, a pre-authorization may be placed on their credit card. This pre-authorization is a temporary hold on funds to ensure credit availability to cover potential additional charges, such as damages or extra charges during their stay. The pre-authorization is not a final charge; the funds are not withdrawn from the Guest's account, but their available funds are temporarily reduced.
Once the stay is over and the Guest has verified that there are no outstanding balances, the Host will request a cancellation of the pre-authorization; this will release the funds held on the Guest's credit card, restoring their available credit limit. The time it takes for the release of funds to be reflected depends solely on your banking institution, although this process can generally vary between 24 and 72 hours. However, some banks may take longer to update your available balance. This release will not appear as a transaction or refund on your statement; you will simply notice that your credit line or available balance has returned to normal.
The Host will inform the Guest about the pre-authorization process at the time of their Reservation and/or Check-in, and will be available to answer any questions or provide clarification regarding this process. It is the Guest's responsibility to provide accurate and up-to-date credit card information to avoid inconveniences or delays in the pre-authorization process, as well as to ensure that their credit card has sufficient funds or a credit line to cover the pre-authorization amount. Otherwise, the Host reserves the right to cancel the Reservation and deny access to the Guest.
NINETEENTH.- ILLEGAL ACTIVITIES.-The Guest, their companions, visitors, and/or the occupants of the Property, by virtue of their sole use, agree to occupy it solely and exclusively for the purpose indicated in this Agreement. In the event of noncompliance, they will be solely responsible for the use given to said property. If any crime is committed on the Property, they will be directly liable before the competent authorities or courts of common or federal jurisdiction, thereby releasing the Property, the Host, and/or the owners from all liability.
The Guest, their companions, visitors and/or the occupants of the Property agree not to possess, consume, use or allow the storage of any type of weapons, gunpowder or explosives in said property; as well as psychotropic drugs, drugs of any nature, instruments to process them and/or any other of a similar nature that serve or have served to commit any crime, or that are an instrument or product of such. Therefore, they are and will be directly responsible in the event that the Property, the Host and/or the owners are involved in such crimes, the parties accepting that any practice to the contrary will be cause for immediate termination of this Contract and that the competent authorities will be called to intervene.
The Guest, their companions, visitors and/or the occupants of the Property, expressly agree to remove the Property, the Host and/or owners, or their representatives safe and sound in the event that said Property is involved in any proceeding, including, but not limited to, before the local or Federal Public Prosecutor's Office due to the application of the "Domain Forfeiture Law for the Federal District" or its Federal or locally applicable counterpart.
In the event that the Guest, their companions, visitors and/or the occupants of the Property use it for a purpose other than that indicated and for this reason the Law of Extinction of Domain, whether federal or local, is applied, they are obliged to indemnify the Host and/or owners of the Property, for the amount resulting from applying the commercial value that the Property had at the time of the declaration of extinction of domain, and must cover said indemnity no later than within 30 days following notification thereof to the Host and/or owners of the Property.
Likewise, the Guest, their companions, visitors and/or the occupants of the Property, are obligated to remove the Property, the Host and/or owners, or their representatives, safe and sound, in the event that any procedure for violation of the Civic Culture Law of Mexico City or the Commercial Establishments Law of Mexico City is initiated due to their fault, and they are also obligated to pay the costs and attorney's fees, as well as the reparation of the damage caused. It is the obligation of the Guest, their companions, visitors and/or the occupants of the Property, to immediately inform the "Host and/or owners, or their representatives, about any notification, procedure or trial brought against them.
TWENTIETH.- ENVIRONMENTAL POLICY.-The Host is committed to protecting the rights of nature, comprised of all its ecosystems and species, as a collective entity with rights. Consequently, it will promote the care and sustainable use of natural resources, and the Guest is obligated to use them efficiently and sustainably.
The Guest will carry out their activities avoiding generating any type of pollution and affecting health, air quality, climate, environmental conservation, ecological protection, or causing damage to the environment, biodiversity, and natural resources.
The Host will establish a comprehensive waste management policy in accordance with Mexico City environmental standards, taking into account the sustainable use of water and the treatment of wastewater from its activities.
TWENTY-FIRST. LIABILITY TO THE HOST.-In any case, the Guest must compensate for any damages caused to the Host, their companions, or their guests, whether due to their own personal or property misconduct, bad faith, negligence, or negligence; including those caused by defamation or slander, as well as any impact on the operation and flow of business, or unfair competition.
TWENTY-SECOND. DISPUTE RESOLUTION.-For all matters relating to the interpretation, application, and enforcement of this Agreement, the Parties agree to resolve their disputes through amicable settlement. If a mutual settlement is not possible, they agree to submit to mediation by the Technology Platforms or OTAs through which the Reservation was confirmed. Only if this mechanism fails to achieve settlement between the Parties, do they agree to submit to arbitration by the Federal Consumer Protection Agency (Procuraduría Federal del Consumidor), based in Mexico City. Only if disputes persist, do they agree to submit to the jurisdiction of the competent courts of Mexico City.
The Parties declare that they have read this Agreement and its Annexes, and that they agree to all of its Terms and Conditions. Therefore, by confirming the Reservation, signing the Registration Form (Annex A) or using the Property, they indistinctly grant their consent to be bound by mutual agreement in accordance with the same, in Mexico City, on the date on which any of these assumptions are updated. THE PARTIES.
PROPERTY REGULATIONS (ANNEX B)
For the purposes of these Regulations, the term "Property" shall be understood to mean both the building or place where the Accommodation Services covered by the Contract are provided, as well as the space, room, or apartment specifically reserved by the Guest. When specific reference is made to "the private spaces of the property," the latter shall be understood.
In accordance with the provisions of the Contract, during their stay at the Property and by the mere fact of using it, the Guest and their companions and visitors will be subject to the following rules:
The Host is not responsible for valuables, documents, jewelry, money, etc., left in the private or public areas of the property if they are not deposited in the safe deposit boxes and registered.
Check-out time is 10:00 (ten) hours. If you wish to change the date or time of departure or add a companion, you must notify the Host and pay the current rates according to the Rate List (Annex C).
If you require additional services, you must request the Additional Services Price List (Annex D).
Any damage or loss caused to the Property, its furnishings, installations or finishes, which is duly verified according to the depreciation of the property, will be automatically charged to the Guest through the pre-authorized payment method at the replacement value or the value to compensate for the damage.
Any person occupying the Property must register in advance on the Registration Form (Annex A) and observe the rules of hygiene and social coexistence.
Access to the property with any type of weapon is strictly prohibited without the corresponding valid license or authorization, in accordance with Articles 24 and 35 of the Federal Law on Firearms and Explosives. In these cases, the carrying of weapons must not disturb the peace and order of the property.
Only assistance or companion dogs are allowed in the Property, as long as they have been previously authorized by the Host.
Dogs must be kept on a leash or harness at all times in all public areas; and they may not be left alone at any time, even within the building's private areas.
The private spaces of the property must be used exclusively for residential purposes, and both the Guest and their companions must treat them as if they were their own.
It is prohibited to remove furniture, appliances, household goods, decorative items, or any other objects from the private spaces of the property.
Activities that generate noise that affects third parties or that disrupt public order or social interests in the Property are prohibited.
Conduct that violates the rules, or that is offensive or discriminatory, is not permitted on the premises.
Smoking is not permitted in the private areas of the building, nor in any enclosed areas accessible to the public.
The Host must notify the competent authorities if the safety of persons is affected, public order or social interest is disturbed, or if a crime is possibly committed on the Property.
The competent authorities must be allowed access to the private spaces of the property in any of the cases indicated in the previous section; otherwise, the use of public force will be permitted.
Parking, if applicable, is provided as a courtesy by the Host, and the Host is not responsible for any material damage, theft, or loss, whether total or partial, suffered by the Guest's vehicle or the objects inside.
Recordings from security cameras located in public spaces may only be provided to the competent authorities upon request for justified reasons.
By the day of check-out, the Guest must have paid the total rate for the accommodation and the total price of the additional services.
It is strictly prohibited to enter other private spaces, apartments, or rooms without the express consent of their occupants, and only if capacity permits.
Quiet hours at the property are from 11:00 PM to 9:00 AM.
All property left behind in the Property will be removed and deposited at the Guest's expense, according to the rate indicated in the Fee Schedule (Annex C).
The Guest will carry out their activities avoiding generating any type of pollution and affecting health, air quality, climate, environmental conservation, ecological protection, or causing damage to the environment, biodiversity, and natural resources.

The Guest accepts all the terms and conditions of the Accommodation and Occasional Tourist Stay Services Contract (the Contract).
The Guest authorizes the Host to use their credit or debit card to pre-authorize charges or hold sufficient funds to guarantee payment of the Hosting Fee, the Price of additional and/or complementary services, as well as the Total Hosting Fee or the total bill, including last-minute charges and any damages caused to the Property.
